Terms of Service

1. Overview

qwelto is operated by El Yazid Tebbaa ("we", "us", or "our"). We provide AI-assisted software tools for creating brand identity assets such as logos, banners, visual directions, and brand kits. By accessing or using qwelto, you agree to these Terms of Service.

2. Eligibility and accounts

You must provide accurate account information and keep your sign-in credentials secure. You are responsible for activity that happens through your account.

3. Acceptable use

You may not use qwelto to violate laws, infringe intellectual property rights, impersonate others, create deceptive or harmful materials, abuse our systems, or interfere with the service. We may suspend access if we believe your use creates legal, security, payment, or platform risk.

4. User content and generated assets

You keep ownership of content you submit to qwelto. Subject to your compliance with these terms and payment of applicable fees, you may use generated brand assets for personal or commercial projects. You are responsible for the prompts, names, content, designs, and other materials you submit, and for the assets you select, modify, download, publish, register, or otherwise use. You must ensure that your use complies with applicable law and does not infringe another party's trademark, copyright, privacy, publicity, or other rights.

Before using an output commercially or applying to register it, you are responsible for conducting appropriate trademark, intellectual-property, and legal clearance checks. You are also responsible for claims or disputes caused by your submitted content, selections, modifications, or use of generated assets.

5. AI output limitations

AI-assisted outputs may be imperfect, similar to other designs, or unsuitable for a specific legal or commercial purpose. qwelto does not guarantee that an output is unique, available for trademark registration, free from similarity to existing designs or brands, legally cleared, or capable of producing a particular business result.

6. Payments and subscriptions

Paid features may be offered as subscriptions or one-time digital purchases. Prices, billing periods, taxes, renewal terms, and cancellation options will be shown at checkout. You authorize our payment provider to process applicable charges for the plan or product you select.

6a. Lifetime access

Where a product is described as providing “lifetime access” (including the Founder Pass), this means access for the operational lifetime of the qwelto service, with no recurring or renewal fee. Lifetime access covers the features included in that tier and ongoing improvements to them. It does not automatically include separately-priced add-ons or higher tiers introduced later. It does not guarantee that the service will be operated for any particular period, that any individual feature will remain available, or that third-party services qwelto depends on will remain available. If we discontinue the service, we will give reasonable advance notice and a reasonable opportunity to export your saved designs and brand assets.

7. Cancellations and refunds

You may cancel future subscription renewals according to the instructions available in your account or checkout receipt. Refunds are handled according to our Refund Policy.

If you purchase through a third-party marketplace, that marketplace's checkout, refund period, and buyer terms also apply. When a marketplace confirms a refund, the corresponding redemption code and Founder Pass access may be deactivated. A marketplace purchase does not give the marketplace access to qwelto source code, hosting, payment credentials, API keys, or customer databases.

8. Intellectual property

qwelto, including its software, interface, branding, systems, and non-user content, is owned by qwelto or its licensors. These terms do not grant you ownership of the qwelto platform itself.

9. Service changes

We may modify, suspend, or discontinue features as the product evolves. We will try to avoid unnecessary disruption, but we do not guarantee that every feature will remain available forever.

10. Disclaimers and liability

qwelto is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties and are not liable for indirect, incidental, special, consequential, or lost-profit damages arising from your use of the service.

To the extent permitted by applicable law, qwelto is not responsible for claims, losses, or disputes arising from your prompts, submitted materials, selections, modifications, publication, registration, or use of generated outputs. Nothing in these terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited, including responsibility for our own breach where applicable law requires it.
